Terms of Service

1. Definitions

"Trackback", "we", "us" or "our" means Rightlander Limited (company number 10852894), a company registered in England and Wales at 86–90 Paul Street, London EC2A 4NE, trading as Trackback. "You" or "Customer" means the legal entity that subscribes to the Service. "Service" means the Trackback web application, dashboards, scans, Health Reports and any related APIs or notifications. "Agreement" means these Terms together with any order form, pricing schedule or written addendum.

2. Account & eligibility

By creating an account you confirm that you are authorised to bind your organisation, are at least 18 years old, and will provide accurate billing and contact details. You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out under them. Notify us at support@trackback.io if you suspect unauthorised use.

3. The Service

Trackback provides scanning, scoring and risk monitoring for the affiliate tracking domains you submit. We grant you a non-exclusive, non-transferable, revocable licence to use the Service for your internal business purposes during the subscription term. You retain ownership of all data you submit; we own the platform, scoring models, indicators and aggregated insights derived from running the Service.

4. Acceptable use

You must not, and must not allow any third party to:

  • Submit domains you do not own or do not have authorisation to monitor.
  • Use the Service to harass, defame or unlawfully target any individual or business.
  • Reverse-engineer, decompile or attempt to extract the source code of the Service.
  • Resell, sublicence or expose the Service to a third party as a managed offering without our prior written consent.
  • Use the Service to send unsolicited bulk communications, malware, or content that infringes third-party rights.
  • Interfere with the Service's security, integrity or availability — including automated scraping of pages outside the documented API rate limits.

We may suspend or terminate accounts that breach this clause, with or without notice, depending on severity.

5. Fees, billing & renewal

Fees are set out on the pricing page or in your order form, and are payable monthly or annually in advance in GBP unless otherwise agreed. All fees exclude VAT, which is added where applicable. Subscriptions renew automatically at the end of each term unless you cancel via the dashboard or in writing at least seven (7) days before the renewal date. Failed payments may result in suspension after 14 days' written notice.

We may increase fees at renewal with at least 30 days' notice. The first three months of every new subscription are discounted, in recognition of the 90-day window during which structural insights build.

6. Data protection

Each party will comply with applicable data-protection law. Our processing of personal data is described in the Privacy Policy. Where we act as a processor on your behalf, the data processing addendum available at support@trackback.io applies.

7. Confidentiality

Each party will keep the other's confidential information secret and use it only to perform the Agreement. Confidential information does not include information that is public through no fault of the receiving party, was already known to it, or is independently developed without reference to confidential information.

8. Warranties & disclaimers

We warrant that the Service will perform materially in accordance with our published documentation. To the maximum extent permitted by law, all other warranties — including merchantability, fitness for a particular purpose and non-infringement — are excluded. Trackback surfaces signals and scores; it does not constitute legal, compliance or financial advice. You remain solely responsible for decisions taken in reliance on Service outputs.

9. Limitation of liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law. Subject to that, each party's aggregate liability for any claim arising out of or in connection with the Agreement is capped at the fees paid by you to us in the twelve (12) months preceding the claim. Neither party is liable for indirect, special, consequential or punitive damages, including loss of profit, revenue, anticipated savings, goodwill or data.

10. Termination

Either party may terminate the Agreement for material breach not cured within 30 days of written notice. We may suspend the Service immediately for non-payment, security risk, or breach of the Acceptable Use clause. On termination you will pay all outstanding fees and we will provide you with a reasonable period (at least 30 days) to export your data, after which we will delete it in accordance with the Privacy Policy.

11. Governing law & jurisdiction

This Agreement is governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any dispute, except that we may bring proceedings in any jurisdiction where you have assets to enforce our intellectual-property rights.

12. Miscellaneous

If any provision is held unenforceable, the remainder will continue in effect. The Agreement is the entire agreement between the parties on its subject matter. We may update these Terms; material changes will be notified at least 14 days in advance by email or in-product banner. Contact: support@trackback.io.
